1. Introduction

These Terms of Service ("Terms") form a legally binding agreement between MoveToCanada ("MoveToCanada", "we", "us", or "our") and you, the user of movetocanada.com (the "Site"). They govern your access to and use of the Site, our services, and any content, features, or functionality offered on or through the Site.

By accessing or using the Site, creating an account, submitting an inquiry, applying for a listing, or paying for a subscription, you agree to be bound by these Terms and by our Privacy Policy and Cookie Policy, which are incorporated by reference. If you do not agree to these Terms, you must not use the Site.

These Terms include important provisions that affect your legal rights, including a limitation of liability (section 17), an indemnification obligation (section 18), a governing law and exclusive forum clause (section 19), and Quebec-specific provisions (section 23).

2. Definitions

In these Terms:

  • "Applicant" means any person or business that submits an application to be listed as a Lawyer or Service Provider.
  • "Inquiry" means any contact form submission, message, or communication sent through the Site by a Visitor to a Lawyer or Service Provider.
  • "Lawyer" means an immigration lawyer who has been approved by us and holds an active listing on the Site for one or more cities.
  • "Listing Content" means all content submitted by a Lawyer or Service Provider for inclusion on the Site, including biographical information, firm or business name, photographs, video introductions, areas of practice or service categories, language proficiencies, descriptions, contact details, websites, and any other materials.
  • "Service Provider" means a moving company, real estate agent, insurance broker, banker, tax accountant, or other relocation services business that has been approved by us and holds an active listing on the Site for one or more cities and categories.
  • "Subscription" means a paid recurring listing subscription on the Site.
  • "User" means any person who accesses or uses the Site, including Visitors, Applicants, Lawyers, and Service Providers.
  • "Visitor" means any person who accesses the Site without being a Lawyer, Service Provider, or Applicant — typically a prospective immigrant or member of the public seeking information about Canadian immigration.

3. Eligibility and Acceptance

You must be at least 16 years old to use the Site. To create an account, apply for a listing, or enter into a Subscription, you must be at least 18 years old (or the age of majority in your province or territory, whichever is greater) and have the legal capacity to enter into a binding contract.

By using the Site, you represent and warrant that you meet these eligibility requirements and that all information you submit is accurate, current, and complete.

If you are accepting these Terms on behalf of a business or other legal entity (such as a law firm or service provider company), you represent and warrant that you have the authority to bind that entity to these Terms, and "you" will refer to both you personally and the entity.

4. Description of the Service

MoveToCanada operates an online directory that connects prospective immigrants and newcomers with:

  • Immigration lawyers licensed in Canadian provinces — exactly one Lawyer is listed per city; and
  • Relocation service providers in five categories: moving companies, real estate agents, insurance brokers, bankers, and tax accountants — exactly one Service Provider is listed per category per city.

We provide a platform for Visitors to discover Lawyers and Service Providers, browse profile information, submit Inquiries, and use ancillary tools such as the eligibility quiz and informational resources. We do not provide legal services, real estate services, financial services, tax services, moving services, or insurance services ourselves. Our role is limited to operating the directory and the related platform.

We may add, change, or remove features, listings, cities, or categories at any time. We may also operate parallel sites for other countries (such as MoveToAmerica.com); those sites are governed by their own terms.

5. Not a Law Firm; No Legal Advice; No Solicitor-Client Relationship

MoveToCanada is not a law firm. We do not practise law, do not provide legal advice or legal services, and do not represent any User in any legal matter.

Information available on the Site — including city pages, immigration program descriptions, blog articles, the eligibility quiz, FAQs, and any other content — is provided for general informational purposes only and is not legal advice. Do not rely on Site content as a substitute for advice from a qualified immigration lawyer.

No solicitor-client relationship is created between you and MoveToCanada by your use of the Site. Submitting an Inquiry through the Site forwards your message to the Lawyer listed for the relevant city, but does not by itself create a solicitor-client relationship between you and that Lawyer. A solicitor-client relationship arises only if and when you and the Lawyer enter into a separate retainer or engagement agreement directly.

The eligibility quiz uses simple rule-based scoring against publicly available immigration program criteria and produces only general informational guidance. The quiz is not an immigration decision, an application, or a professional assessment, and its results may not reflect your true eligibility for any program.

6. Visitor Terms

6.1 Permitted use

As a Visitor, you may access the Site, browse listings, read content, submit Inquiries to listed Lawyers and Service Providers, and use ancillary tools such as the eligibility quiz. The Site and its content are intended for your personal, non-commercial use.

6.2 Inquiry routing and exclusivity

When you submit an Inquiry through a city page or Lawyer profile, your Inquiry is forwarded only to the single Lawyer currently listed for that city. We do not share your Inquiry with any other lawyer, with our broader network, or with any aggregator. Service Provider Inquiries are similarly limited to the single Service Provider in the relevant category and city.

6.3 Inquiry conduct

You agree not to submit false, misleading, or fraudulent Inquiries; you must not impersonate another person or misrepresent your circumstances. You agree to use Inquiries only to seek genuine immigration or relocation services, not to spam, solicit, scrape, or harass Lawyers or Service Providers.

6.4 No guarantee of response

We facilitate the routing of Inquiries but do not guarantee that any Lawyer or Service Provider will respond to your Inquiry, or respond within any particular timeframe.

7. Lawyer Listings

7.1 Application and admin approval

Lawyers may apply to be listed by completing the application form on the Site. All applications are subject to administrative review by MoveToCanada, including verification of bar admission. We may approve, decline, or request additional information at our discretion. Submission of an application does not guarantee approval, and no listing is created until we expressly approve the application and the first Subscription payment is successfully processed.

7.2 Pricing

Lawyer Subscriptions are offered at the following prices, in Canadian dollars, exclusive of any applicable taxes:

  • CA$97 per month, or
  • CA$970 per year (representing approximately a two-month discount).

Prices may change from time to time; existing Subscriptions are billed at the price in effect when the Subscription was created or most recently renewed, until we provide notice of a price change as described in section 10.6.

7.3 Exclusivity

We list exactly one Lawyer per city. While a Lawyer's Subscription for a city is active and in good standing, no other lawyer will be listed for that same city on the Site. This commercial exclusivity does not constitute an endorsement, recommendation, or representation by MoveToCanada that the listed Lawyer is superior to other lawyers practising in that city.

7.4 Licence verification and ongoing obligations

At the time of onboarding, we verify that the Lawyer holds a valid licence in good standing with the relevant Canadian provincial law society or, in Quebec, with the Barreau du Québec or the Chambre des notaires du Québec (the "Governing Bar"). We do not continuously monitor licence status. The Lawyer must:

(a) maintain their licence in good standing with the Governing Bar throughout the Subscription term; (b) immediately notify us at legal@movetocanada.com if their licence is suspended, revoked, restricted, or under disciplinary investigation; (c) maintain professional liability insurance as required by the Governing Bar; and (d) immediately update Listing Content to remove any practice areas they are no longer authorized to practise.

7.5 Bar advertising compliance

The Lawyer is solely responsible for ensuring that all Listing Content complies with the marketing, advertising, professional conduct, and other rules of the Governing Bar, including (without limitation) the Law Society of Ontario's Rules of Professional Conduct, the Law Society of British Columbia's Code of Professional Conduct, the Code of ethics of advocates of the Barreau du Québec, and the equivalent rules of any other Governing Bar.

The Lawyer represents and warrants that:

(a) all Listing Content is truthful, accurate, not misleading, and does not contain prohibited testimonials, prohibited comparisons, prohibited claims of specialization or expertise, or any other content prohibited or restricted by the Governing Bar; (b) all required disclaimers under the Governing Bar's rules are included in the Listing Content where applicable; and (c) the Lawyer has independently reviewed all Listing Content for compliance with the Governing Bar's rules before submitting it to us.

MoveToCanada does not review or approve Listing Content for bar advertising compliance. Our review is limited to verifying licence status, basic identity, and obvious unsuitability of content (such as profanity or unrelated subject matter). Approval of a listing by us is not a representation that the Listing Content complies with the Governing Bar's rules.

If we receive notice that any Listing Content may not comply with applicable bar rules, we may at our discretion remove or modify that content, suspend the listing, or require the Lawyer to make changes, without refund.

7.6 Indemnification by the Lawyer

The Lawyer agrees to indemnify, defend, and hold harmless MoveToCanada and its directors, officers, employees, contractors, and agents from and against any claim, complaint, demand, regulatory investigation, disciplinary proceeding, lawsuit, loss, liability, judgment, settlement, fine, penalty, cost, or expense (including reasonable legal fees) arising out of or related to:

(a) any Listing Content submitted by the Lawyer; (b) the Lawyer's breach of any representation, warranty, or covenant in these Terms; (c) any complaint to the Governing Bar or other regulator concerning the Lawyer's listing or conduct; or (d) the Lawyer's provision (or alleged provision) of legal services to any Visitor, including any claim of professional negligence or breach of fiduciary duty.

7.7 Listing content licence

The Lawyer grants MoveToCanada a worldwide, non-exclusive, royalty-free licence to host, display, reproduce, format, modify (only for technical formatting purposes), and distribute the Listing Content for the purpose of operating the Site, marketing the directory, and providing the services described in these Terms. This licence ends when the listing is removed, except that we may retain Listing Content in archival backups for a reasonable period and may continue to display the Lawyer's name and city in historical references where reasonably required.

8. Service Provider Listings

8.1 Application and admin approval

Service Providers may apply to be listed by completing the application form on the Site. All applications are subject to administrative review, including verification of any required professional licensing (for example, real estate registration with the relevant provincial regulator, insurance licensing, mortgage broker licensing, or CPA designation, as applicable to the Service Provider's category). We may approve, decline, or request additional information at our discretion.

8.2 Pricing

Service Provider Subscriptions are offered at CA$39.99 per month per category per city, in Canadian dollars, exclusive of any applicable taxes. A Service Provider may hold subscriptions in multiple categories and multiple cities, each priced separately.

Prices may change from time to time as described in section 10.6.

8.3 Categories

Service Provider listings are available in the following five categories only:

(a) Moving Company, (b) Real Estate Agent, (c) Insurance Broker, (d) Banker, and (e) Tax Accountant.

We may add, modify, or remove categories from time to time.

8.4 Exclusivity

We list exactly one Service Provider per category per city. While a Service Provider's Subscription is active and in good standing, no other service provider will be listed for that same category in that same city. As with Lawyer listings, this exclusivity is a commercial arrangement and does not constitute endorsement.

8.5 Licensing and conduct

The Service Provider must maintain any licences, registrations, or professional designations required to provide their services in the relevant province throughout the Subscription term, comply with all applicable laws, and provide accurate and non-misleading information in their Listing Content. The Service Provider must immediately notify us of any material change to their licensing or registration status.

8.6 Indemnification by the Service Provider

The Service Provider agrees to indemnify, defend, and hold harmless MoveToCanada and its directors, officers, employees, contractors, and agents on the same terms as set out in section 7.6, with the necessary modifications to refer to the Service Provider's category and services rather than legal services.

8.7 Listing content licence

The Service Provider grants MoveToCanada the same Listing Content licence as set out in section 7.7.

9. Account Registration and Security

To create or manage a listing or to receive Inquiries, you must create an account. You agree to:

(a) provide accurate and complete information when creating your account and keep it up to date; (b) maintain the security and confidentiality of your password and any other authentication credentials; (c) not share your account credentials with any other person; (d) immediately notify us at security@movetocanada.com of any unauthorized access to your account or any other suspected breach of security; and (e) be responsible for all activity that occurs under your account, whether authorized by you or not, until you have notified us of any compromise.

We may require multi-factor authentication for sensitive account operations.

10. Subscriptions, Billing, and Refunds

10.1 Payment processing

All Subscription payments are processed by Stripe, our third-party payment processor. By subscribing, you agree to Stripe's terms and authorize Stripe to charge your payment method on our behalf. We do not store your full credit card information; we receive only metadata as described in our Privacy Policy.

10.2 Auto-renewal

Subscriptions automatically renew at the end of each billing period for another period of the same length, at the then-current price for that Subscription type. By subscribing, you authorize MoveToCanada (through Stripe) to charge your payment method on file at each renewal until you cancel. For annual Subscriptions, we will send a reminder email at least seven (7) days before each renewal.

10.3 Cancellation

You may cancel your Subscription at any time through your account dashboard or by emailing billing@movetocanada.com. Cancellation takes effect at the end of the current billing period; your listing remains active until that date. We do not pro-rate or refund partial billing periods.

10.4 No refunds for active subscriptions

Subscriptions are non-refundable. Except as specifically set out in section 10.5, we do not offer refunds for any reason, including (without limitation): cancellation by you, removal of your listing for breach of these Terms, lack of inquiries, dissatisfaction with the platform, change of business circumstances, or unused portions of a billing period.

10.5 Refund of rejected applications

If we reject a Lawyer Application or Service Provider Application during administrative review, any Subscription charge collected during the application process will be automatically refunded to the original payment method within seven (7) business days of the rejection decision. We may not be able to refund third-party processing fees that Stripe does not return to us; in that case, we will refund the amount received from Stripe, net of those non-recoverable fees, and will identify any such deduction.

10.6 Price changes

We may change the price of any Subscription type at any time, in our sole discretion, including by increasing the price, decreasing the price, modifying any discount structure, or changing the relationship between monthly and annual pricing. A price change applies as follows:

(a) New Subscriptions — The new price applies to any Subscription created on or after the effective date of the change.

(b) Existing monthly Subscriptions — The new price applies to your next monthly renewal that occurs at least fourteen (14) days after we send you notice of the change. Renewals scheduled to occur during that fourteen (14) day notice period are charged at the existing price.

(c) Existing annual Subscriptions — The new price applies to your next annual renewal that occurs at least fourteen (14) days after we send you notice of the change. The remainder of your current paid annual period is honoured at the price you originally paid; we will not retroactively charge you the difference.

(d) Notice — Notice of a price change will be sent by email to the address associated with your account. We may also display a notice on your account dashboard.

(e) Your options — If you do not agree to a new price, you may cancel your Subscription at any time before the new price takes effect for you, and you will not be charged the new price. Continuing your Subscription past that date constitutes acceptance of the new price.

For clarity: nothing in this section limits our right to change prices, and you have no right or expectation that the price of your Subscription will remain the same beyond your current paid billing period.

10.7 Failed payments

If a renewal payment fails, we will attempt to retry the payment over a period of up to ten (10) days. If payment is not successfully completed within that period, your listing will be suspended. If payment is not received within thirty (30) days of the original failed renewal, your Subscription will be terminated and your listing removed, subject to the data retention provisions of our Privacy Policy.

10.8 Taxes

Prices stated in these Terms and on the Site are exclusive of applicable taxes (GST, HST, QST, or provincial sales taxes), which will be added to your invoice based on your billing address.

10.9 Chargebacks

If you initiate a chargeback or payment dispute with your card issuer for any charge that we believe was validly incurred under these Terms, we may suspend your account pending resolution of the dispute and may pursue recovery of the disputed amount through any lawful means.

11. User-Generated Content

"User Content" means any content (other than Listing Content covered in sections 7.7 and 8.7) that you submit to or through the Site, including Inquiries, quiz responses, support communications, and feedback.

You retain ownership of your User Content. By submitting User Content, you grant MoveToCanada a worldwide, non-exclusive, royalty-free, sublicensable licence to use, host, store, reproduce, modify (for formatting purposes only), and display that content as necessary to operate the Site and provide the services described in these Terms.

You represent and warrant that you have all necessary rights to grant this licence and that your User Content does not violate the rights of any third party.

12. Intellectual Property

All content on the Site that is not Listing Content or User Content — including the Site design, layout, graphics, logos, code, written content (other than third-party content), and the eligibility quiz logic — is owned by MoveToCanada or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may view, print, and download Site content for your personal, non-commercial use only. You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, sell, license, or otherwise commercially exploit any Site content without our prior written permission.

The names "MoveToCanada", "MoveToAmerica", and any associated logos and slogans are trademarks of MoveToCanada. Other trademarks shown on the Site (including law firm logos and service provider logos) are the property of their respective owners.

13. Acceptable Use

You agree not to:

(a) use the Site in violation of any applicable law or regulation; (b) submit false, misleading, fraudulent, or impersonating information; (c) scrape, crawl, harvest, or extract data from the Site by automated means, except for legitimate search engine indexing; (d) reverse-engineer, decompile, or attempt to derive the source code of any Site software; (e) interfere with or disrupt the Site, its servers, or its networks, including by introducing malware, viruses, or denial-of-service traffic; (f) circumvent any security or access controls, including rate limits, reCAPTCHA challenges, or authentication; (g) use the Site to send unsolicited commercial communications, spam, or chain messages; (h) harass, threaten, defame, or discriminate against any other User; (i) submit content that infringes any third party's intellectual property, privacy, or other rights; (j) submit content that is obscene, hateful, or otherwise objectionable; (k) use the Site to compete with us, including by building a competing directory using our data; or (l) attempt to gain unauthorized access to any User account, the administrative panel, or any non-public area of the Site.

14. Suspension and Termination

We may suspend or terminate your access to the Site, your account, or any listing at any time, with or without notice, if:

(a) you breach these Terms; (b) you fail to pay amounts owed; (c) we receive a credible complaint about your conduct or Listing Content; (d) for Lawyers, your licence with the Governing Bar is suspended, revoked, or restricted, or you are subject to a disciplinary investigation we determine in good faith is material; (e) for Service Providers, you lose any required licence, registration, or professional designation; (f) we are required to do so by law, regulation, or court order; or (g) we cease offering the service or any portion of it.

Upon termination, your right to access the Site ends, but sections that by their nature should survive (including sections 5, 7.6, 7.7, 8.6, 8.7, 11, 12, 16, 17, 18, 19, 22, and 24) will survive termination.

15. Third-Party Links and Services

The Site contains links to external websites and resources, including Lawyer websites, Service Provider websites, government resources (such as IRCC), and informational articles. We do not control, endorse, or assume responsibility for any third-party websites or services.

Your interactions with third parties through the Site — including engaging a Lawyer or Service Provider for paid services — are solely between you and that third party. MoveToCanada is not a party to those relationships, and we are not responsible for the conduct, services, fees, advice, or outcomes of any third party. You should conduct your own due diligence before engaging any Lawyer or Service Provider listed on the Site.

16. Disclaimer of Warranties

THE SITE AND ALL CONTENT, FEATURES, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT ANY WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MOVETOCANADA EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND COMPLETENESS.

WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT:

(a) THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; (b) ANY DEFECTS WILL BE CORRECTED; (c) THE SITE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; (d) ANY LAWYER OR SERVICE PROVIDER LISTED ON THE SITE IS COMPETENT, AVAILABLE, ETHICAL, OR SUITABLE FOR YOUR NEEDS; (e) ANY INFORMATION ON THE SITE — INCLUDING IMMIGRATION PROGRAM DETAILS, COST OF LIVING DATA, OR ELIGIBILITY QUIZ RESULTS — IS CURRENT, ACCURATE, OR APPLICABLE TO YOUR CIRCUMSTANCES; OR (f) USE OF THE SITE WILL RESULT IN ANY PARTICULAR OUTCOME, INCLUDING ANY IMMIGRATION OUTCOME.

Some jurisdictions do not allow the disclaimer of certain implied warranties; in those jurisdictions, the foregoing disclaimers apply only to the maximum extent permitted by law.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL MOVETOCANADA OR ITS DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, GOODWILL, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE OR THESE TERMS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED CANADIAN DOLLARS (CA$100).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, fraudulent misrepresentation, gross negligence, willful misconduct, or any other liability that cannot be excluded as a matter of law.

18. Indemnification

In addition to the specific indemnification obligations of Lawyers (section 7.6) and Service Providers (section 8.6), each User agrees to indemnify, defend, and hold harmless MoveToCanada and its directors, officers, employees, contractors, and agents from and against any claim, demand, lawsuit, loss, liability, judgment, settlement, fine, penalty, cost, or expense (including reasonable legal fees) arising out of or related to:

(a) your access to or use of the Site; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) your violation of any third party's rights, including intellectual property, privacy, publicity, or contract rights; or (e) any content you submit to or through the Site.

We may, at our option, assume the exclusive defence and control of any matter subject to indemnification by you. You agree to cooperate with our defence of any such claim and to not settle any such claim without our prior written consent.

19. Governing Law and Dispute Resolution

19.1 Governing law

These Terms and any dispute or claim arising out of or relating to these Terms, the Site, or your use of the Site (whether in contract, tort, statute, or otherwise) are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict of laws principles.

19.2 Exclusive forum

You and MoveToCanada agree that any action, suit, or proceeding arising out of or relating to these Terms, the Site, or your use of the Site will be brought exclusively in the courts of the Province of Ontario, sitting in Toronto. You and MoveToCanada irrevocably attorn to the exclusive jurisdiction of those courts.

19.3 Time limit on claims

Except where prohibited by applicable law, any claim or cause of action you may have arising out of or related to these Terms or your use of the Site must be filed within two (2) years after the claim or cause of action arose, or be permanently barred.

19.4 Equitable relief

Notwithstanding section 19.2, MoveToCanada may seek injunctive, equitable, or other urgent relief in any court of competent jurisdiction to protect its intellectual property, confidential information, or other rights.

20. Modifications to These Terms

We may modify these Terms from time to time. When we make material changes, we will:

(a) update the "Last updated" date at the top of these Terms; (b) post the updated Terms on the Site; and (c) where the changes meaningfully affect your rights or obligations (such as changes to fees, refunds, dispute resolution, or indemnification), provide at least thirty (30) days' notice by email to registered Users before the changes take effect.

Your continued use of the Site or continued payment of Subscription fees after the effective date of the updated Terms constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, your sole remedy is to stop using the Site and, if you have a Subscription, to cancel it before the updated Terms take effect.

21. Notices and Electronic Communications

You consent to receive communications from us electronically, including by email, by notices posted on the Site, and through your account dashboard. Electronic communications satisfy any legal requirement that communications be in writing.

Notices to you will be sent to the email address associated with your account or, for Visitors, the email address associated with your Inquiry, quiz, or newsletter signup. You are responsible for keeping your email address current.

22. General Provisions

22.1 Entire agreement

These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and MoveToCanada with respect to the Site and supersede any prior or contemporaneous agreements, communications, or understandings.

22.2 Severability

If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or, if no such modification is possible, severed from these Terms. The remaining provisions will continue in full force and effect.

22.3 No waiver

Our failure to enforce any provision of these Terms is not a waiver of that provision or of any other provision. Any waiver must be in writing and signed by an authorized representative of MoveToCanada.

22.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms without restriction, including in connection with a merger, acquisition, financing, reorganization, or sale of assets.

22.5 Force majeure

We will not be liable for any failure or delay in performance of these Terms caused by events beyond our reasonable control, including acts of God, natural disasters, pandemics, war, terrorism, civil unrest, government action, labour disputes, internet or telecommunications outages, or failures of third-party services.

22.6 Independent contractors

Nothing in these Terms creates a partnership, joint venture, agency, employment, or fiduciary relationship between you and MoveToCanada.

22.7 No third-party beneficiaries

These Terms are for the benefit of you and MoveToCanada only and do not confer any rights on any third party, except that the indemnification provisions extend to MoveToCanada's directors, officers, employees, contractors, and agents.

22.8 Headings

Section headings are for convenience only and do not affect the interpretation of these Terms.

23. Quebec Residents

If you are a resident of the Province of Quebec, certain provisions of the Quebec Consumer Protection Act and the Civil Code of Québec may apply to your use of the Site. Nothing in these Terms is intended to limit any rights you have under Quebec law that cannot be waived by contract. To the extent that any provision of these Terms is inconsistent with mandatory Quebec law as applied to you, that provision will be read down to the minimum extent necessary to comply.
